Generally driving while intoxicated convictions (DWI’s) are not subject to being expunged. Instead, in some circumstances these records can be sealed. The Expungement Process in New York

The court has discretion and on a case by case basis decides whether to allow the criminal conviction to be expunged. Generally speaking to have a criminal conviction expunged you must have been convicted as a juvenile, convicted of an allowable drug related offense, or have been arrested in a case and not convicted.
