Miranda Rights – Protected by New York and Long Island Criminal Defense Lawyer
Individuals charged or about to be charged with crimes have rights in the United States which comes from the 1966 United States Supreme Court case entitled Miranda vs. Arizona. This case stands for the proposition that when a person is taken into police custody before they can be questioned they must be told about their fifth amendment right to avoid self incriminating statements. The following are the Miranda Rights as they exist in New York State today:
- You have the right to remain silent;
- Anything you say can and will be used against you in a court of law;
- You have a right to an attorney;
- If you cannot afford an attorney one will be appointed for you.
