Father’s Rights, A Growing Phenomenon
Why do fathers need their rights protected? The answer is simple. Many fathers find the Family Court and the Supreme Court in matrimonial and family law matters favor mothers. The law in New York is clear, fathers are entitled to equal rights regarding custody and visitation with their children. However, sometimes fathers face uphill battles when they go to court.
Children’s Opinion In Custody Cases
The law in New York has changed. Law guardians are now called attorneys for the children. These attorneys are appointed to represent children in custody and visitation disputes. Prior to the change in the law, the law guardian’s responsibility was to argue for legal positions that were in the children’s best interest. It is now the attorney for the children’s responsibility to argue a child’s position. Should the children seek to live with the father instead of the mother, their attorney will make the court aware of the children’s opinion. In some cases in our office, teenage sons and daughters have been requesting they reside with their father. In custody disputes and proceedings, courts will take the children’s position into consideration when deciding which parent will receive custody. However, the children’s position is not controlling on this issue.
