What Is Bankruptcy?
Bankruptcy is a legal proceeding whereby individuals submit documents to a Bankruptcy Court showing their current inability to pay their debts. The purpose of the bankruptcy statute is to give debtors “a fresh start.” There are two types of consumer bankruptcies. Chapter 7 is a bankruptcy which involves the liquidation of a debtor’s non exempt assets, which usually amounts to the liquidation of none of their assets because there are no non exempt assets worth liquidating. In the Chapter 7 bankruptcy most debtors pay nothing and discharge all of their debts! The Chapter 13 bankruptcy is a repayment plan where a debtor pays a percentage of his or her debts off over a period of time.
