Shoplifting
Retail theft of merchandise can be a misdemeanor or a felony crime, depending on the value of merchandise stolen (more or less than $400). Sentencing is increased for previous shoplifting convictions. First offenders may qualify for the Nassau County’s special education programs which can result in the dismissal of charges or a plea bargain to a lesser offense. Repeat offenders can be jailed for up to a year for misdemeanors and one year and more for felony theft.
Burglary
Entering a residence or business unlawfully to steal merchandise is a felony crime, which can be punishable by a sentence of up to two to five years in prison. We can sometimes obtain a plea bargain on these charges to lesser charges that do not require prison sentences.
